1. Agreement and provider
These Terms govern your use of yoyolingo, provided by HappyCalf Media LLC, 30 N Gould St Ste N, Sheridan, WY 82801, United States (“we,” “us,” or “yoyolingo”). By creating an account, purchasing a plan, or using the service, you agree to these Terms.
2. Eligibility
The Services are intended only for users who are at least 18 years old. By creating an account or using the Services, you represent that you are at least 18 years old. Persons under 18 are not permitted to use or register for the Services. We may restrict or close an account if we reasonably believe that this requirement has not been met.
3. The service
yoyolingo is a desktop language-learning tool for media you import. It can prepare audio or video for sentence-by-sentence playback, vary speed and repetition, show or generate subtitles and translations, provide vocabulary definitions, and export saved words. Machine-generated transcriptions, translations, pronunciations, and definitions can be inaccurate and are learning aids, not professional advice.
4. Your media and acceptable use
You are responsible for ensuring that you may lawfully access and use media you import. You must not use yoyolingo to infringe copyright, bypass DRM or access controls, distribute unauthorized copies, break the law, harm others, interfere with the service, probe its security, or misuse automated systems. yoyolingo does not supply, search, or host third-party media catalogs.
5. Accounts and security
You must provide accurate account information, confirm that you meet the age requirement, and protect access to your email and devices. Tell us promptly about suspected unauthorized use. We may restrict or suspend access when reasonably necessary to protect users, the Services, or comply with law.
6. Plans, promotional credits, renewal, and payment
Plan terms, translation allowances, validity periods, and renewal behavior are shown before purchase. “Translation hours” means the aggregate duration of translated media, not application usage time.
Eligible new users may claim a one-time introductory allowance of 10 hours of AI translation use, valid for 7 days from activation. During registration, a user may optionally enter a referral code. When a valid referral code is redeemed, the invited user and the referring user may each receive 5 hours of promotional AI translation use, valid for 7 days. A referral code may be redeemed only once, and each eligible referring user may be issued no more than two referral codes. Promotional credits are non-transferable, have no cash value, may not be sold or exchanged, and do not automatically renew. We may withhold, adjust, or revoke promotional credits where reasonably necessary to prevent fraud, abuse, error, or violation of these Terms.
Only a membership plan identified at checkout as a Monthly plan automatically renews monthly until cancelled. Fixed-duration membership plans, including 30-day, 180-day, and annual plans, and translation booster purchases do not automatically renew unless checkout expressly states otherwise. The applicable price, billing period, renewal terms, and cancellation method will be displayed before purchase.
Payments are processed through Paddle, which may act as merchant of record for applicable transactions. Payment methods, taxes, billing, receipts, and refund processing are subject to the information displayed at checkout, the applicable Paddle terms, and mandatory consumer rights.
7. Cancellation and refunds
You may cancel an automatically renewing Monthly plan at any time by logging in to your account and using the subscription-management link to access the Paddle Customer Portal. Cancellation takes effect at the end of the then-current paid term. Fixed-duration plans and translation booster purchases do not require cancellation because they do not automatically renew. Refunds are governed by our Refund Policy, Paddle’s checkout terms, and mandatory consumer rights in your location.
8. Intellectual property
We and our licensors retain rights in the application, branding, software, design, and service. You retain rights you hold in your imported media and learning data. These Terms grant a limited, personal, non-transferable right to use yoyolingo while your access is valid.
9. Availability and changes
We may update the service for security, compatibility, legal, or product reasons. Online features can be unavailable due to maintenance, networks, providers, or events outside our control. We will provide reasonable notice of material changes when required, including by posting an updated version and, where required, by email.
10. Disclaimers and liability
To the maximum extent permitted by law, the service is provided “as is” and “as available.” We do not guarantee uninterrupted operation or error-free AI output. Nothing excludes liability or consumer rights that cannot lawfully be excluded. To the extent permitted by law, HappyCalf Media LLC is not liable for indirect, incidental, special, consequential, or lost-profit damages arising from use of the service.
11. Governing law and disputes
These Terms are governed by the laws of Wyoming, United States, without regard to conflict-of-law rules. Courts located in Sheridan County, Wyoming have jurisdiction, except where mandatory consumer law gives you the right to bring a claim elsewhere. Before filing a claim, please contact us and allow a reasonable opportunity to resolve it informally.
